During the trial, Judge Stephan Krieger had previously asked the young man why he had a metal baseball bat with him on an August night in 2020 when he interfered in a verbal argument between his companion and a 22-year-old from Lindlar on Wilhelm-Breidenbach-Weg.

The two men wanted to “clarify something about a woman,” said the later victim on the witness stand. According to the indictment, the defendant pushed himself into the conversation first, then went to his vehicle and fetched the bat.

He struck twice with it, according to the public prosecutor. The first time the child of the same age was able to duck back, the second blow hit him on the head. The Lindlar man came to the hospital later.

Nocturnal argument at the sports center

“It was not the usual time to play baseball,” Krieger asked the defendant. He in turn asserted that he had trained in the school yard of the secondary school before the attack. In their plea, the public prosecutor assessed it as an untrue protective claim.

However, the Lindlarer conceded the blows. He apologized to his opponent, he had already paid him compensation for pain and suffering before the trial. However, this did not save him from a sensitive judgment. The court followed the prosecution’s request and found the charge of dangerous bodily harm upheld.

In the reasoning for the judgment, it emphasized the danger of corresponding blows to the head. Because the Lindlar man had also threatened the victim, who was lying on the ground, not to report the incident, an attempted coercion was made. The verdict: Seven months in prison on probation.
