The facts date back to the night between October 31st and November 1st when the Carabinieri intervened in a discotheque in Lanciano where a Halloween-themed dance evening was in progress with the administration of food and drinks. The immediate verification allowed the military to identify the presence of about 500 people, partly already inside and partly waiting to access it, as well as the failure to respect the interpersonal distancing.
The subsequent administrative checks carried out by the Carabinieri of the Operational and Radiomobile Nucleus directed by Lieutenant Giuseppe Nestola, made it possible to ascertain that the party had been organized in a room rented by an association. The building did not have a license pursuant to Article 68 of the TULPS and that the number of patrons was significantly higher than that foreseen given the anti Covid restrictions.
In the light of what has been ascertained, for the organizer DM 35 of the place, the report to the Public Prosecutor’s Office for the violation of article 681 CP for having opened places of public entertainment, entertainment or meeting, without having observed the provisions of ‘Authority for the protection of public safety, a crime that provides for the arrest of up to six months and a fine of no less than 103 euros. stable, due to exceeding the maximum capacity foreseen, for non-compliance with the safety distance and for the violation of the rules on the administration of food and alcoholic beverages.
Further investigations are underway by the Carabinieri at the competent offices to establish the real existence of the premises and safety conditions as required by Article 80 of the TULPS.
