The judge decided to drop the accusation related to 54 crimes, understanding that Rui Pinto should not be tried for the violation of correspondence of those who did not file a complaint. “The matter relating to the absence of a complaint is liable to nullity,” said the judge. This was a situation defended by Rui Pinto’s defense in the request to open an investigation.

In addition, the judge concluded that the Portuguese courts are competent to try Rui Pinto in relation to the attempted extortion of Doyen.

As for the lawyer Aníbal Pinto, the magistrate understands that he must go to trial in the exact terms of the accusation: that is, accused of attempted extortion. “As for the probation nullity invoked by the defendant Aníbal Pinto, it has no legal support”, he said.

The decision was announced through the criminal investigating judge (JIC) Cláudia Pina, this Friday, after a first postponement last Monday, with the change the legal qualification of crimes.

At the time, Cláudia Pina reported that 68 of the crimes of illegitimate access for which Rui Pinto is accused should be converted into crimes of improper access, justifying the decision by the fact that the accused accessed the mailboxes of the injured parties and not computer systems.

In September 2019, the Public Ministry (MP) accused Rui Pinto of 147 crimes, 75 of which were illegitimate access, 70 of violation of correspondence, seven of them aggravated, one of computer sabotage and one of extortion attempt, for accessing the systems information technology from Sporting, Doyen, the law firm PLMJ, the Portuguese Football Federation and the Attorney General’s Office, and for the subsequent disclosure of dozens of confidential documents of these entities.
