NFL Hall of Fame running back Emmitt Smith faces a civil fraud lawsuit filed in the Delaware Court of Chancery by Kituwah LLC, the economic development and investment arm of the Eastern Band of Cherokee Indians, accusing the former Dallas Cowboys star and his business associates of diverting a $2.5 million loan intended for a Texas energy project.
The legal action, brought against Smith, business partner David Mosley, and their real estate firm 4 13 Solutions Inc., centers on an agreement finalized in September 2023. According to court filings, Kituwah agreed to lend $2.5 million at an annual interest rate of 12 percent to finance Project Exodus, a solar energy initiative planned for the Caldwell County area between Austin and San Antonio, Texas.
Kituwah claims in the lawsuit that it has not recovered "even a cent" of the principal, which was due to be repaid by February 1, 2024.
Instead of funding the Texas venture, the lawsuit alleges that the capital was redirected to settle prior financial commitments that 4 13 Solutions owed to Wilson Holdings of North America, a firm represented by Darrel Wilson. Legal representatives for Kituwah characterized the arrangement in court documents as “essentially a Ponzi scheme,” noting that the payment to Wilson Holdings was contingent on Project Exodus securing permanent financing—a milestone that was never achieved.
Darrel Wilson acknowledged receiving a $2.5 million transfer from Smith’s company but stated he was unaware of the reason for the transfer. Meanwhile, representatives for 4 13 Solutions allegedly ignored subsequent demands for reimbursement as construction deadlines passed without progress.
Legal Allegations and Financial Claims
Court documents outline extensive communications and subsequent silence from the defendants after the February 1, 2024 repayment deadline lapsed. Kituwah asserts that it was forced to fund its own internal investigation to trace the missing capital after 4 13 Solutions failed to provide answers during inquiries.

The lawsuit details that the project was initially framed as a vast enterprise carrying an overall investment valuation of 396 million dollars, with net income projections approaching nearly 14 million dollars in net income during its inaugural year. In addition to the principal amount, the loan accumulated roughly 600,000 dollars in interest. Kituwah’s legal team has asked a jury to determine financial damages and compensation for the losses incurred.
