DFB Chef Schmaus: Suspended Sentence Explained

In the summer, the DFB is chasing the title at the World Cup in the USA, Canada and Mexico. The chef has now been sentenced to probation.

Regensburg – The head chef of the German national soccer team, Anton Schmaus, was sentenced to a suspended sentence by the Regensburg district court on Friday (January 16). The court considered it proven that the 44-year-old star chef had violated applicable law in his Regensburg restaurants when calculating social security contributions, such as, among other things Bavarian Radio reported.

The verdict is a nine-month suspended prison sentence. In addition, Schmaus must pay 9,000 euros to the state treasury and reimburse the resulting social security damage of over 37,000 euros. His co-defendant, former assistant, received a fine for aiding and abetting.

The judge was convinced that Schmaus, as the operator of several restaurants in Regensburg, withheld and embezzled wages from two cleaning workers. The two cleaners were employed as part-time workers, but worked above the wage limit above which mini-jobs are subject to social security contributions.

According to the court ruling, the wages for these additional hours were paid to other part-time employees – these were acquaintances or relatives of the cleaning staff, some of whom were only employed for appearances. This was intended to avoid the social security contributions that are actually due, like that Bavarian Radio reported further.

In the original indictment, the public prosecutor’s office assumed a total damage amount of over 47,000 euros. However, the judge acquitted Schmaus of some of the allegations because these charges were not confirmed in the main hearing.

In his verdict, the judge emphasized that he did not assume that the star chef was interested in saving money. Rather, he assumes that a quick decision was made here that was not a happy one. The proceedings began after a dispute between Schmaus and his former assistant and her termination following her statements to customs.

Anton Schmaus has been working as head chef for the German national football team since August 2017 and runs the Michelin-starred restaurant “Storstad” in Regensburg. The legal proceedings have no impact on his DFB commitment, as the DFB clarified upon request: “We have known Mr. Schmaus as a reliable and responsible employee for many years. There is therefore no impact on his existing commitment.” The verdict is not yet final – Schmaus’ lawyer Jörg Meyer announced after the announcement that legal action would be taken.
