The cause of the collaborator
Now, however, the case of the employee arises. As reported by Daily Factfor ten years a collaborator, employed in the school secretariat and responsible for enrollments and memberships, worked six days a week with tasks that according to the judges effectively constituted an employment relationship.
Despite the lack of a formal contract with protections such as holidays or fixed salary, the Court of Appeal of Rome recognized the nature relationship employee and condemned the company.
The sentence: compensation confirmed and non-payment
On appeal the woman obtained recognition of approximately 16 thousand euros in compensation plus 80 thousand euros in accumulated salary differences and legal costsin addition to the request for reinstatement. The decision became final in October, but the payments they have not yet been carried out.
The matter could now bring the company to the bankruptcy court, where it will have to demonstrate its financial situation after the request presented by the employee’s lawyer.
