Barcelona – In a landmark decision, Spain’s Data Protection Agency (AEPD) has levied a 2,000 euro fine against an individual for the dissemination of AI-generated images depicting naked minors. This pioneering sanction, stemming from events in 2023, involved the creation and distribution of non-consensual intimate imagery of teenagers from Almendralejo, a town in the Badajoz province. The AI technology was used to superimpose the faces of these minors onto sexually explicit images.
The examination into this disturbing case began after widespread media coverage.The National Police identified several minors as perhaps involved in the creation of these images. Concurrently, the AEPD initiated its own inquiry, which was further spurred by a formal complaint lodged by the family of one of the victims.
The AEPD’s investigation concluded by identifying a minor who has now been fined. The family opted for a voluntary payment of 1,200 euros, a reduced amount granted for acknowledging the facts. While the official resolution was issued two months prior, its details only came to light recently. It is understood that this sanction is not isolated,and further penalties may follow,as multiple individuals are believed to have been involved in the dissemination of these harmful images. Even though the AEPD’s resolution does not explicitly link these specific actions to the widely reported incidents in Badajoz, agency sources have confirmed the connection.
This administrative action by the AEPD has proceeded in parallel with a criminal investigation led by the Juvenile Court of Badajoz. Last year, that court imposed a supervised release measure on fifteen minors found responsible for the distribution of these AI-generated images. The legal proceedings were initiated following a joint complaint filed by the mothers of the affected minors.
The court ultimately held fifteen minors accountable for twenty counts of child pornography and other offenses against moral integrity. As part of their sentencing, these individuals are required to undergo specialized training throughout the current year. This training focuses on sexual and affective education, the responsible use of details and communication technologies, and raising awareness regarding equality and gender issues.
