Argentine Court Upholds Dismissal of Rugby Players in Rape Case
Argentine justice, in a Tuesday, February 18th ruling, upheld the initial dismissal of charges against French rugby players Oscar Jégou and Hugo Auradou. The players, initially accused of aggravated rape, were exonerated by a lower court in December.
A Turning Point in the Case
On December 10th, Judge eleonora Arenas dismissed the case against Jégou and Auradou, citing a lack of evidence supporting the serious accusations. This decision, following months of inquiry and legal maneuvering, marked a significant turning point.
The accusations and the Defence
The two players, both 21, were accused of aggravated rape after a match between France’s XV of France and Argentina. The alleged incident occurred in a Mendoza hotel room between July 6th and 7th. the defense argued the sexual encounter was consensual, a claim vehemently disputed by the complainant.
Appeal and Further Legal Action
Despite the initial dismissal, the complainant’s lawyer, Mo romano, appealed the decision, arguing that the investigation was incomplete. Romano demanded a resumption of the investigation and a trial.she vowed to exhaust all legal avenues, including appeals to the Provincial Supreme Court and potentially the Inter-American Court of Human Rights in Costa Rica.
The Court’s Reasoning
The appellate court, after a three-hour hearing on February 10th, ultimately sided with the lower court’s decision. The judges cited a lack of evidence to support the serious accusations against the players. This decision underscores the importance of rigorous legal processes in such sensitive cases.
