the Ultim Class will not appeal the court decision favorable to Gabart but does not disarm

The Ultim 32/23 Class will not appeal the “temporary” authorization from the Paris Court of Justice, but invites the navigator to carry out work to bring himself into compliance beyond the Route du Rhum.

«It is high time to leave all its place to sport“. By means of a press release, the Ultim Class has acted on the decision of the Paris court, prior to the authorization for François Gabart to take the start of the Route du Rhum in Saint-Malo, on November 6th. Owner of the maxi-trimaran SVR-Lazartigue, the Kresk group had before the courts the dispute concerning the conformity of the maxi-trimaran of the winner of the Vendée Globe 2012-2013.

«The legal route was never the one desired by the Class to resolve this dispute.regrets the Ultim Class 32/23 in a press release. Unfortunately, she had to force herself to do so following the summons of François Gabart and his partner against her. Thus, although they deplore the decision rendered both in sporting terms and in terms of fairness, and in terms of technical and safety aspects, the shipowners and skippers who make it up consider that, with just over 100 days to go of the mythical transatlantic between Saint-Malo and Pointe-à-Pitre, it is high time to leave all its place to sport.»

Work on the maxi-trimaran after the Route du Rhum

The Class therefore takes note of the decision of the Paris court. A decision deemed temporary: “The judgment rendered on July 21 and the temporary derogation that the Class must provide to the trimaran SVR Lazartigue for the Route du Rhum only concerns this transatlantic race and does not resolve the basic problem of the conformity of the boat and compliance with rule 3.11 as as evidenced by the notice of non-compliance issued by the World Sailing

It is now up to the Kresk group and François Gabart to comply for future races, in particular the round the world in the Class. “If François Gabart wishes to take part in the races on the Ultim 2023 calendar, in particular the round the world race, he will have to proceed, as Didier Tabary committed to in a memorandum of understanding signed on February 16 by all the shipowners and Kresk Development in the presence of the FFVoile, to be carried out at the end of the Route du Rhum, the compliance work necessary to obtain the measurement certificate for their trimaran.»
