The Spanish justice lifts the precautionary measures against UEFA for the Super League

The precautionary measures were agreed by the then head of the court on April 20, 2021.

In September of that year, it was agreed to suspend the procedure and the hearing to oppose the precautionary measures, which was set for March 4, 2022. That day, it was suspended by mutual agreement, in order to be able to negotiate and reach an agreement. agreement.

In the order of April 2021, the judge adopted precautionary measures to prevent any action that prevent the start of the Super Leagueprohibiting FIFA, UEFA and all their associated Federations or Leagues «from adopting any measure that prohibits, restricts, limits or conditions in any way, directly or indirectly, the start-up of the Super League».

In addition, the judge prohibited taking “any sanctioning or disciplinary measure against the participating clubs, their players and managers.” From that moment, the court had not summoned the parties to the mandatory oral hearing to definitively decide on those measures.

At that time, the head of the court was Judge Manuel Ruiz de Lara, who did not manage to convene the parties and, therefore, did not set a time limit on the precautionary measures and ordered the suspension of the main proceedings after raising the question for a preliminary ruling before the Court of Justice of the EU (CJEU). Subsequently, and without having concluded the precautionary piece, the aforementioned judge agreed to resume the main procedure, which he suspended again after being challenged.

The new judge, Sofía Gil García, set a date for the precautionary hearing, which has led to the decision adopted this Thursday, after having given the parties the opportunity to reach an agreement.

The so-called Super League was a initiative of twelve of the most important clubs in Europe, including Real Madrid, Barcelona and Atlético de Madrid, who then announced the creation of this European-wide competition outside of UEFA. The idea was dropped just two days after it was pitched because nine of the 12 teams defected.
