In Tarbes: three years in prison for the couple who attacked a mother and her two children

The man and woman accused of having violently assaulted a mother and her two children on December 22 in Tarbes, were sentenced on Monday to three years of imprisonment.

“I was tired of being the stuffing turkey. »Clenched jaw, monotonous voice, Sylvain tries to explain the reasons which pushed him to attack his ex-partner and the two children of the latter (the eldest is their common daughter) on December 22 in Tarbes with bats baseball, with the help of Clémence, his current companion. Arrested on January 5 in the Landes, and presented this Monday at an immediate appearance hearing before the court of Tarbes, both were prosecuted for aggravated violence with a weapon in a meeting, in particular on minors under 15 years old.
Two days before Christmas Eve, the very “good chic, good kind” couple in their thirties came from the Landes where they live, hooded, gloved, and armed with a baseball bat, to enter the home of the victims. “A real punitive expedition”, notes Me Sophie Bernard-Broucaret, lawyer for the mother of the family and the attacked little girls. “One of you rang the intercom and pretended to be a delivery man, with a cardboard box under his arm,” recounts the president of the court. The mother of the family is not suspicious and opens her door. “According to the victim, a masked woman she does not know breaks into her home followed by a man, takes out a baseball bat from the cardboard box and begins to beat her”, continues the magistrate. Children are not immune to this surge of hatred. The older two-year-old is on the floor, her one-year-old sister is found by her mother in the sink, her head under the open water tap.

“A child in the back”

“It did not happen that way,” denies the couple in concert. “A discussion escalated,” says Sylvain. “I wanted to see the condition of the apartment, and to know where the alimony money I was going to pay. According to him, his daughter lived in an unsanitary apartment and in a state of deplorable filth. These statements were confirmed by the president, who presented her assessors with the photographic album produced by the police in the accommodation of the victims. A situation that he can no longer bear, especially since he says he is in depression since his ex-partner told him in 2019 that she was pregnant with him, and that she wanted to keep the child despite his refusal.

Clémence, his new companion, supports his companion and testifies to the discomfort he has suffered since the birth of the child. “She wanted to impose on him this paternity which he did not want”; “But if he did not want a child, he could have protected himself”, rebounds the prosecutor. “She assured me that she was taking the pill,” Sylvain whispers. “I still recognized my daughter, because I was not educated like that. But the young man does not want to get involved in the education of this child. Until June 2021, he nevertheless regularly paid financial assistance to the mother, from whom he has since been separated. But when the family court judge announces to him that he will have to pay 220 euros per month in alimony, things change.

Confess the unmentionable

If Clémence and Sylvain both admit having hit the mother of the family, for reasons which remain unclear, it is difficult to give a clear answer to the president who asks: “who hit the children?” Sylvain is formal, he doesn’t know anything. After long minutes, and the insistence of the president, Clémence indicates herself. “They were in their mother’s arms, and the beatings were not intended for them.”
For Me Loréa Chipi, her client “made this story her own, which was not her own.” And to highlight the brilliant career of the young woman from a bourgeois Bordeaux family. For the prosecutor, nothing justifies such violence, especially against children. “You behaved like savages,” he scolds. It requires six years of imprisonment, two of which are suspended. Both are sentenced to three years in prison, which they leave to serve at the end of the hearing.
