Article 4.
For all the above, the DIMAYOR Championship Disciplinary Committee imposes a sanction on the Cali Sports Association Club with suspension of one (1) date of the full place when it acts locally in the next match for the BetPlay Cup 2021, and a fine of seven million two hundred sixty-eight thousand two hundred eight pesos ($ 7,268,208), in accordance with numerals 5 and 6 of article 84 of the CDU of the FCF.
Finally, the Committee has valued that the Club Asociación Deportivo Cali the next match that it would play would be on October 6, 2021 for the semifinal of the BetPlay2021 Cup, in order to promote football and prevent violence in stadiums, so pedagogical the DIMAYOR Championship Disciplinary Committee, will allow minors to attend the stadium, as long as the club’s leadership allows it, with the following conditions: 1. Only minors will be allowed among the seven (7) to twelve (12) years, in the company of one (1) responsible adult. 2. Attendance will have no cost, so no money can be charged for the entrance or attendance of the minor and his only guardian.
An appeal for reconsideration and in subsidy the appeal will proceed against the present.
Article 5.
Teófilo Gutiérrez, from the Club Asociación Deportivo Cali registry, and Gustavo Torres, from the América de Cali SA registry for infringement of literal d, article 63 of the FCF CDU, consisting of violent conduct, within the framework of the Vuelta de la BetPlay DIMAYOR Cup 2021.
In the match played between Asociación Deportivo Cali vs América de Cali SA for the BetPlay Cup 2021 DIMAYOR, the Committee learned about some facts that were duly informed by the referee of the match, through the referee’s report, such as the violent conduct carried out by Teófilo Gutiérrez, from the Cali Sports Association registry, and Gustavo Torres, from the América de Cali registry.
In accordance with the Committee’s sphere of competence (article 141 of the FCF CDU) and in accordance with article 158 of the FCF CDU, both clubs were asked to comment on the matter and provide the evidence that they intended to assert. . Within the regulatory term, the appropriate responses were given. It should be clarified that within articles 3 and 11 of Resolution 040 of September 23, 2021, the conduct was typified with the corresponding normative provision, that is, literal d, article 63, in accordance with what was reported by the arbitrator in the report, that it is violent behavior, so the transcription of “serious foul play” does not correspond to the article so often cited; Both clubs were transferred attaching the arbitration report, to guarantee their right to defense and that they knew the conduct for which they were being investigated, likewise videos of what happened on the pitch between both players were attached.
The arbitration report clearly stated that the conduct for which both players were expelled corresponded to violent conduct, described in literal d), article 63 of the FCF CDU; For its part, the Committee once assessed that the conduct displayed by both players, as well as the evidence in this proceeding and the allegations, determined that there were no circumstances that would allow aggravating the disciplinary responsibility that falls against both players, for what the sanction imposed consists of a suspension of two (2) dates for the BetPlay DIMAYOR Cup 2021 and a fine of ninety-eight thousand ($ 98,423), as established in literal g, art. 19 of the FCF CDU.
