Hungary accepted the request of the Public Prosecutor for the extension of Rui Pinto’s European Arrest Warrant, thus being able to accuse the employee of the Football Leaks for facts found in the investigation related to Doyen and Sporting.
The information is contained in a note published this Thursday on the website of the Central Department of Investigation and Criminal Action (DCIAP), after in July this year the Public Prosecutor’s Office (MP) requested the extension of the European Arrest Warrant (EAW) .
“That request [do MP] had a positive response from the Hungarian authorities, who gave consent, on August 13, 2019, to the extension of the EAW ”, says the note from the DCIAP, adding that the inquiry, led by the MP of the DCIAP with the assistance of the Judiciary Police, is found is under investigation and is under secrecy.
In custody since March 22, the Portuguese Rui Pinto, 30 years old, was arrested in January in Hungary and handed over to the Portuguese authorities, on the basis of an EAW that only covers illegal access to the computer systems of Sporting and the investment fund Doyen Sports, being indicted for the practice of four crimes: illegitimate access, violation of secrecy, offense to the legal person and extortion in the attempted form.
The basis for issuing the European Arrest Warrant is illegal access to Sporting and Doyen Sports‘ computer systems and subsequent disclosure of confidential documents, such as football contracts for the Lisbon club and then coach Jorge Jesus, in addition to other contracts signed between Doyen and several football clubs.
Sporting, Doyen and Benfica have become assistants in the process, which allows them to intervene in the investigation and in the investigation phase, present evidence and request due diligence that they consider necessary.
On the day Rui Pinto was in preventive detention (March 22), a Benfica source told the Lusa agency that he requested information from the MP about the evidence produced in the investigation. Rui Pinto is also suspected of being the author of the theft of emails from Clube da Luz in 2017.
As the defendant never renounced the principle of specialty, so that the Portuguese justice can come to accuse and judge Rui Pinto for facts and crimes other than these, the MP had to request the extension of the EAW to the Hungarian authorities, based on new facts and evidence found in the course of the investigation – which do not appear in the original warrant – and which may give rise to other legal proceedings.
Among these facts, there are access to the email of “large dozens of offended”, namely, magistrates of the MP, members of the Internal Administration, PSP, law firms, FIFA, FC Porto, Nacional and the South American football confederation (CONMEBOL ).
This is the main argument of the MP order, which Lusa had access to, asking the criminal investigating judge (JIC) to declare the special complexity of the process, which would give the investigation an additional six months and, consequently, could keep in preventive detention Rui Pinto, at least until March 22, 2020.
However, this claim of the MP was denied by the JIC, claiming the principle of specialty, since the original EAW covers only the facts related to Doyen and Sporting, which are not considered of special complexity.
This decision by the JIC means that the MP has to bring an indictment against Rui Pinto for the facts related to Doyen and Sporting until 22 September this year (six months after the application of the preventive detention coercion measure), or else the employee of Football Leaks it will have to be released.
