The collective of judges in the Football Leaks case dismissed the requirements presented this Tuesday by Doyen’s lawyers to stop the inquiry line of Rui Pinto’s defense, claiming that the offenders’ “scrutiny” is at stake.
After about an hour of work stoppage of the 26th session of the trial at the Central Criminal Court of Lisbon, the president of the collective, Margarida Alves, returned with the reading of the order, in which she considered that “The assistant doesn’t see reason” of the process and that there was no “No nullity or irregularity” issues, invoking the need to “Guarantee the principle of adversarial” the defense of the creator of the electronic platform.
Despite the position taken by the panel of judges, Doyen’s lawyer, Sofia Ribeiro Branco, reiterated the “irregularity” of the decision. In response, the judge maintained the order, without giving reason to the representatives of Doyen, who sought to limit the inquiry of Rui Pinto’s lawyers to the former administrator of the investment fund Nélio Lucas, who appears today in the courtroom for the third time in this trial .
In the requirements presented at the start of the session, the representatives of the investment fund argued that they had been placed “Issues that have nothing to do with the process” is that “The evidence obtained illegally can only be used against agents and not offended people”, so Nélio Lucas could not be confronted with the documents that Rui Pinto had allegedly illegitimately accessed.
The work of the session was resumed shortly thereafter, with Rui Pinto’s lawyer, Francisco Teixeira da Mota, taking over the continuation of the inquiry to Nélio Lucas about the organization of the Doyen group companies and business carried out over time.
Rui Pinto, 32, is responsible for a total of 90 crimes: 68 of undue access, 14 of violation of correspondence, six of illegitimate access, targeting entities such as Sporting, Doyen, PLMJ law firm, the Portuguese Federation of Football (FPF) and the Attorney General’s Office (PGR), and also for computer sabotage to Sporting’s SAD and for extortion, in the attempted form. This last crime concerns Doyen and was also what led to the pronunciation of the lawyer Aníbal Pinto.
The creator of Football Leaks has been free since August 7, “due to his collaboration” with the Judiciary Police (PJ) and his “critical sense”, but for security reasons, he is part of the protection program of witnesses in an undisclosed location and under police protection.
