Messi is tighter and La Liga says that if he wants to leave he will have to pay

After analyzing the “different interpretations published in recent days in different media” and concluding that “some of them contradictory to each other”, La Liga issued a statement yesterday to clarify the contractual situation between Messi and Barça taking – “to the player’s contract with his club”. So he gives the reason to the club, assuring that if the star wants to leave, he must pay the clause. All this, the day Messi tightened his grip on the rope without appearing, as he had threatened, in the PCR tests.

“The contract is currently in force and has a ‘termination clause’ applicable in the event that Messi decides to urge the unilateral early termination of the same, carried out in accordance with Article 16 of Royal Decree 1006/1985, of 26 of June, by which regulates the special labor relation of the professional sportsmen », explained the organism. Therefore, he warned that “in compliance with the applicable regulations, and following the procedure that corresponds in these cases, La Liga will not carry out the procedure of prior visa of federal leave to the player if it has not previously paid the amount of the clause” .

In this way, the body chaired by Javier Tebas endorses the version of the Barça club and denies that of the Argentine, who yesterday did not appear in the PCR tests carried out in the first team understanding that his contract has expired – Luis Suárez did. In this sense, Messi will not attend the first training session of the course this afternoon (17.30) and opens another chapter in the contractual conflict due to his departure.

The player’s lawyers sent a bureaufax to the club last Tuesday to communicate their desire to leave under the release clause that was included in the contract signed in 2017 and that allows him to leave free at the end of each season. But, in the contract, June 10 is specified as the deadline. The Argentine’s argument is that this is an atypical season due to the coronavirus pandemic, which delayed the end of the school year until August 23.

Using the exceptionality of the moment, Messi and his lawyers consider that with the sending of the bureaufax they made the release clause effective and that he is no longer due to Barça as a worker. Therefore, it did not appear in the PCR tests either. Barça, meanwhile, take the deadline of June 10 and refer it to the termination clause of 700 million euros if it wants to leave. The club may open a serious sanction file, if it deems it appropriate, for not performing the PCR.

It would have been contradictory with his first bureaufax that Messi had appeared in the PCR tests as his advisers consider that the contract has expired. “He doesn’t have to go to training or receive his salary,” Marc Mas, a lawyer and member of Barça’s legal and disciplinary commissions, explained to EFE between 2010 and 2015. “The spirit of the contract would be what could have in favor of Messi, while the club has the agreements are to be kept and it welcomes the fact that the signatory is what it is worth, ”said Juan de Dios Crespo, a lawyer specializing in sports law. “It’s a fact that the season was atypical,” he added.

“If the departure date is identified with a specific date, and it seems so, it is clear that after this date the right of departure has expired,” said Mas. “The exceptional nature of the clause requires its interpretation in a restrictive way and according to its literal tenor.” The exception lies in the fact that “his exercise means being able to terminate the employment contract unilaterally and without compensation for the club, which would naturally end next year.” According to Mas, the date of June 10 is never set in reference to the end of the season. “It is a certain date, until which (until 24 h on June 10) it is possible to exercise the clause.” Today Messi will not go to the first training session either. One more chapter of a serial tense.
